In terms of section 18 of POPI, if personal information is collected, Noir Group (PTY) LTD, as responsible party, must take reasonably practical steps to ensure that the data subject (client) is made aware of the information being collected.
In order for Noir Group (PTY) LTD to comply with our contractual obligations with our clients, Noir Group (PTY) LTD is required to provide ‘advice’ and/or ‘intermediary services’ as per the FAIS Act and Regulations, including providing certain personal information to Product Suppliers. Failure to provide the information will result in failure for Noir Group (PTY) LTD to provide our clients with the best possible financial services. We thus advise that Noir Group (PTY) LTD will be collecting, recording, processing and distributing the personal information provided by the client for the purposes of providing ‘advice’ and/or ‘intermediary services’ as per the FAIS Act and Regulations, including providing certain personal information to Product Suppliers, unless you advise us to the contrary.
